Court Overturns Overreaching
Ambush Elections Rule
The NAM and the Coalition for a Democratic Workplace (CDW), of which the NAM is a leading member, won a victory against the National Labor Relations Board (NLRB) on Monday, May 14, when the U.S. District Court invalidated the NLRB’s flawed and onerous “ambush elections” rule. “Overturning the ambush elections rule is a key victory for job creators and the 12 million men and women working in manufacturing,” said NAM President and CEO Jay Timmons in a statement. “In invalidating the ambush elections rule, the Court rightly rejected one of the Board’s most misguided policies.”
Despite the District Court’s ruling, the NLRB could still attempt to vote on the rule again since the judge based his decision on how the NLRB approved the rule, and the Board now has five members. The Board could also appeal the District Court’s decision to the U.S. Court of Appeals for the D.C. Circuit. The NAM will continue to monitor the NLRB’s efforts to impose onerous regulations on manufacturers. “Manufacturers will continue to fight every aspect of the Board’s overreach and work toward a regulatory environment that fosters economic growth and job creation,” said Timmons.
NAM’S Ex-Im Reauthorization
Campaign Pays Off
With the NAM leading the way, manufacturers scored a significant victory on Tuesday, May 15, when the Senate passed the Export-Import (Ex-Im) Bank Reauthorization Act of 2012 (H.R. 2072) by an overwhelming bipartisan vote. The bill is expected to be signed by the President before Memorial Day, and U.S. exporters will greatly benefit from the reauthorization when it becomes law. “It’s a good day for manufacturers after weeks of uncertainty regarding the future of Ex-Im Bank,” said NAM President and CEO Jay Timmons in a statement. “Today the Senate stood up for jobs by taking quick action on legislation reauthorizing the Bank and increasing its lending authority.” Through an aggressive legislative, communications and advocacy campaign, the NAM played a significant role in securing the Bank’s reauthorization.
